Dear Sir,
I can give only my opinion, It is not final. Any how,at your request, I give the following clarification. A person will be entitled to claim for CNF from the Greffier en Chef of Nationality department, Paris, if he conserves the french nationality or is eligible to obtain it. Nosadays, this eligibility by filiation is objected by the Procureur de la Republique before Courts, u/s 30-3 of code civil.
If the Greffier en chef refuses the application, the applicant may prefer appeal on just grounds before the Law Minister or other competent authority with different designation. The applicant may also file a suit for declaring him as a french national before TGI at Paris by engaging a french advocate. This is one legal way.
The other administrative way is the grant of french nationality by Government order. It is divided into 2 parts. 1) Naturalisation. In this case, any foreigner having five years of continuous residence in France can present his application. The condition of duration of residence may vary in some circumstances,
2) Readmission or reintegration. Here certain persons who had been french nationals can recover that nationality by an order of readmission, without the condition of duration or residence except the condition of residence at the time of applying. The text of Justice Dr.David Annoussamy quoted by me in my previous reply, comes under the category of reintegration which can be asked by the eligible person

y mom was born in pondicherry 11/08/1961.. my grand father was born in pondicherry, my grand mother was born Tamil Nadu... whether my mom is eligible to french nationality.....

If your mother's father made option to conserve the fr. nationality and included your mother's name in his declaration of option,then only she can claim for fr.nationality certificate, I give this reply on the presumption that your mother's paternal grand father also was born in Fr.India. Yours sincerely

The reply is given in English, because it is known to more persons. To your question I give below the extract from the book "French Legal system" by Justice David Annoussamy at page 115.
"Certain persons who had been French nationals can recover that nationality by an order of re-admission. It may be obtained at any age without the condition of duration of residence EXCEPT THE CONDITION OF RESIDENCE AT THE TIME OF APPLYING FOR RE-ADMISSION ....
Persons of French nationality who were domiciled in a territory whcih was previously a French territory at the time of its accession to independance can be re-admitted on condition of having previously established their domicile in France, by way of a declaration made after getting the permission of the Ministry in charge of naturalization. However such a permission would not be necessary for a person who before the accession of their territory to independance has exercised public or political function or had effectively accomplished military service in a French Army unit or has in times of war enlisted himself voluntarily in the French or Alied Forces".
I add that the Franco-Indian Treaty, 1956 came into force on 16.08.1962 and the non optants had lost their french nationality from this date only,

Is there any oppurtunity to get nationality to military man son who did the military service in France and participated in Indochina war. I came to know that there is an article for the military man who did not optioned under the Franco indien treaty. The article 24-1 says like this. But my question is whether his son can again reintegrated into the nationality francaise by going appel.

Supposing to be a new case, I give the reply, You say that your application for CNF was refused for the reason that your father, a renoncant, did not opt to conserve french nationality and thereby lost it and became Indian and you as a minor born in Pondicherry in 1957 followed his condition under the Franco Indian treaty of 1956 which came into force on 16.08.1962. This decision is well founded. You will not succeed if you make appeal before Law minister or file a suit before TGI court at Paris. To do so, you have no valid ground under the above treaty. Regarding French nationality..
Hello sir,
I am devarajou yoga and I am a renoncant. My father did renonciation at pondicherry. I applied the French nationality in service de la nationalite. They refused my application for the reason for not make option by my father. I was born in pondicherry on 4 Mai 1957. I made my application by mentioned as due to personal reason my father did not make option. Actually after I was born, my father and mother gave me to his sister who lived in koumbakonom(inde anglaise ). I have the proof that I lived in Union territory during the merge of Franco Indian treaty. I am going to appel and submit this proof of living there during the jure. The proof is my school TC. In that TC it was mentioned that I was studied in Union territory. Shall I move through this point and could I able to get the French nationality? I know that you are right person and good advocate to say the advice.

Sir,
If your application is prima facie in order, you may get within six months your file number while asking you to wait for 22 months, as a large number of applications are submitted every year. There is no time limit to return the applicatios not in order, It seems that regular applications are examined in serial order. Y0urs sincerely

This is jemes.. How many days will require if the service de la nationalite rejects the application?
If there is no rights they will reject it soon.i.e, 6-12 months?
