Sir,
Please study again in my previous reply the situation of a renoncant optant conserving the french nationality and of a renoncant non optant losing french nationality and becoming Indian on 16.08.1962. Then you can engage a french advocate in France to file a suit before a competent french court, if you are so advised. Yours sincerely

Sir.
The reply is given in English, because it is known to more persons. To your question I give below the extract from the book "French Legal system" by Justice David Annoussamy at page 115.
"Certain persons who had been French nationals can recover that nationality by an order of re-admission. It may be obtained at any age without the condition of duration of residence EXCEPT THE CONDITION OF RESIDENCE AT THE TIME OF APPLYING FOR RE-ADMISSION ....
Persons of French nationality who were domiciled in a territory whcih was previously a French territory at the time of its accession to independance can be re-admitted on condition of having previously established their domicile in France, by way of a declaration made after getting the permission of the Ministry in charge of naturalization. However such a permission would not be necessary for a person who before the accession of their territory to independance has exercised public or political function or had effectively accomplished military service in a French Army unit or has in times of war enlisted himself voluntarily in the French or Alied Forces".
I add that the Franco-Indian Treaty, 1956 came into force on 16.08.1962 and the non optants had lost their french nationality from this date only,
Yours sincerely
David

Sir,
Renonciation is a general term but you are concerned with renonciation to personal law. It is a very different regulation existing with regard to french India. It is contained in a decret dated 21st september 1881. The change of category results from a simple declaration of willingness by the person who desires to acquire the french law (statut francais). This declaration can be made either before the etat civil officer of the place of residence of tha applicant or before the Juge de Paix assisted by Greffier and two witnesses or before a notary
The deed of renuciation has for consequence a complete change of statute with regard to public law as well as the private law. There is no change for a renoncant optant, he is governed by french law. But a renoncant non optant becomes Indian but he continues to be governed by French law (code civil) as far as his personal law is concerned ie. marriage, divorce, adoption, succession etc.. You can refer also to the proces verbal agree annexed to the franco Indian treaty 1956 regarding cession of Fr.India to Indian Union, w.e.f 16.o8.1962.
A suit for French nationality can be filed only before the competent court- TGI, in France. not in India. Yours sincerely

Sir,
You were born in French India. If your father was french and born in French India, he should have submitted his declaation of option to conserve the french nationality and also included your name therein. Then only you are eligible to claim for nationality certificate by using your french birth certificate. Yours sincerely
