Thank you for your email correspondence of 31 January with attachments on behalf of Mr ????, about the immigration status of his wife, Mrs ????.



Mrs ????? submitted an application for entry clearance as a spouse on 9 September 2013. This application is currently pending. Please pass Mr ??? my apologies for this.



I understand that Mr ??? is anxious for news about his wife’s application. Under our customer service standards our Visa Sections aim to process 95% of settlement applications within 12 weeks and 100% within 24 weeks. However, we cannot guarantee that all visa applications will be completed within this time, as the unique circumstances of each individual case may result in longer processing times. Settlement applications are generally more complex than other categories of visa, often requiring further checks either locally or in the UK.



As you may be aware, on 5 July 2013, the High Court handed down its judgment in a Judicial Review of the minimum income threshold for non-European Economic Area partners and dependent children under the family Immigration Rules. Those rules were brought in to make sure that family migrants coming to live in the UK would not become reliant on the taxpayer for financial support and would be able to integrate effectively. We are therefore pleased that the judgment supports the basis of our approach.

We do not agree, however, with the judgment’s assessment of certain of the detailed requirements of the income threshold rules. We are therefore pursuing an appeal against the judgment. This will be heard by the Court of Appeal in March 2014. Until the legal challenge has been finally determined by the Courts, where an applicant does not meet the minimum income threshold and there is no other reason to refuse it, the application will be put on hold.

I can confirm that on 5 February, we wrote to Mr ???? to advise him of this and also confirmed that we were in the process of carrying out additional checks. Mr ???? was advised that should the results of our checks show that his wife’s application meets the requirements of the Immigration Rules, we will make a decision on her application as quickly as possible. However, if the evidence provided shows that the minimum income threshold has not been met, or that significant evidence is missing, Mrs ????application will be ‘paused’ pending the outcome of the Court of Appeal in March 2014
