Mr(MP name) wrote to UK Visas and Immigration regarding your husband’s application for a visa on 1 April 2014. UKVI aim to provide a response to Mr...... within 20 working days and as yet we are yet to have received a response from them other than acknowledgement to inform us that they are looking into the matter. As you will be aware the 20 working day period is due to expire on Monday 28 April and I will contact UKVI then to chase up a response to Mr (MP name)’s enquiry if we still have not received a response by then. I submitted application on 12/11/2013 in ISB

Sister the income threshold requirement is a rule not the law so therefore this change can be made at anytime. Only changes to the law or new laws are implemented in April so therefore there is nothing to worry about they will change the rule whenever the decision has been made.

I personally believe they have decided but are waiting for the local elections to get out of the way and then they will announce the change of rule. The decision will come from the House of Lords and not from the courts (Justice Blake) because if it was coming from the court we would have known by now but the delay is from the parliament. Well that's my opinion.

Inshallah everyone will get good news soon, they cannot keep peoples lives on hold forever.

It's just the some courts disagreed in the £18,600 and it's gona go to court but they haven't decided when the rules change some families it's too much they haven't said when they gonna decided.but normally in UK APRIL is when they change the rules and laws.in UK about finance and business tax credits and stuff like that..don't know when does they make decision on hold cases!

In July 2012 the UK Home Office introduced new rules that require a minimum income threshold of £18,600 in order to sponsor the settlement of the spouse, partner, fiancé or proposed civil partner in the UK, with a higher threshold for any children also sponsored: £22,400 for one child and an additional £2,400 for each further child.

The new rules caused a public outcry and have obviously had a huge impact as the financial requirement is simply out of reach for many applicants.

The issue was taken to court, and in July 2013, the UK High Court found the controversial UK immigration rules requiring the minimum income as 'unjustified and disproportionate' where the sponsor is a refugee or a British citizen. Following this judgement the UK Home Office announced that it will place all decisions that do not meet the minimum income threshold criteria on hold, until further notice. This pause in considerations is still continuing today.

The UK Home Office furthermore filed an appeal against the July 2013 judgement. The appeal was heard in the Court of Appeal in the beginning of March 2014, and judgment on the appeal is currently awaited.

Whatever the outcome of the challenge, things could possibly change again soon, as legislation is expected that will set out the Government's definition of the balance to be struck between the financial requirements for spouse and visa applications and the public interest.
