I am French nationality. I am now 55. My husband is Indian and working in Indian government. Whether I am eligible to get french pension
Sir,
You were born in 1952 and a minor on 16.08.1962, date of Independance of Fr. India. So you are governed by the franco indian treaty, 1956. According to the said treaty if your father was born in Fr.India he should have opted to conserve french nationality and included your name in the said declaration. He did not do so and became Indian. So, You followed his condition and became Indian. You have not mentioned your place of your birth,to be more complete my reply,
In the case of your wife, she was born in 1963 after independance of Fr.India. So she has to prove that at the time of her birth, her parents were french. You say that they did not opt for fr. nationality and became Indians. In these conditions your wife cannot claim for fr.nationality.
Relying on your details this reply is given, It will be more accurate, if given after examining your papers and discussion tete a tete,. Yours sincerely
I was born in 1952. Both my parents were Indian after the 1962 treaty. But my maternal grandparents were French. My parents didn't take the option of French during the treaty. On the other side, my wife was born in 1963 and my wife's grandparents were also French and her parents didn't take the option of French during the treaty. Both are renoncant families. We even have proof of their birth, marriage and death certificates and proof of voter id, carte d'identité of my wife's grandmother and few more supporting documents. Is it possible to do anything with these?

Sir
Your parents' marriage is prohibited u/s 163 of french civil code. For Hindus it is allowed under Hindu law. If your parents are governed in the matter of marriage by Hindu law as their personal law, they can try to take this plea. Yours sincerely
