ZAMBIAN WIDOW CRYING FOUL
DAMBE ASSOCIATES 08/04/2013
I Nora Sitwala Lutangu Gros have gathered some information that I would like to share with you concerning the case between me and Michael Gros. And I would like you to go through this and advise so as to move closer to the end of this case which has been there for the past 8 years.
Let me begin by expressing my disappointment that this case has really taken too long and wish to end this case as soon as possible.
Am still doing my researches until this case is put to rest.
1. I wish to re-register the fraud case against Michael Roger Gros in which he had awarded himself 99% shares in Desert Technical Services and gave Bernard Nicholas Gros 1% as evidenced by the share certificates he produced on the 5th of November 2005. Attached is the certificate itself. This happened two weeks after the death of my husband Bernard Nicholas Gros (16th October 2005). In December 2005, Michael R. Gros told me in person to move out of Botswana because there was nothing for me and my son Maxwell Gros here in Botswana and that all properties left behind by my late husband belonged to his (Michael Gros) family. This made my life so miserable and had nothing to feed on my kids.
2. I then acquired a letter from the District Commissioner and the KGOTLA for me to access the money from my husband’s account and his estates under Desert Technical Services. The account was with Standard Chattered Bank and it was account number 1 …………………………………… which belonged to my husband and account 2 belonged to Michael Gros. Account number 1 was closed and instructions were given to the bank by Michael Roger Gros to stop anyone from accessing the account and to get any information concerning the account for my late husband. This even made it harder for me to fend for myself. I have therefore decided to have information on how much was in the account and demand the full share I deserve to have for my son Maxwell Gros. I have also attached the letter written by Michael Roger Gros to the bank. In December 2005 itself, Michael sold the Land rover V8 belonging to my late husband at P4000.00 and he also wanted to sale the stallion as well which belonged to my husband so he could raise the money for me to go home (Zambia). In the same week I went to Women Against Rape and lodged in the case, and was told that they could only handle the case the following year being 2006. This made me loose hope and felt helpless.
3. In 2006 when the matter was with the court, the mother (Edith Gros) to Bernard and Michael Gros made an affidavit in which she claimed to be the owner of the machines used by my late husband in his workshop. And that she came with the machines from South Africa with her late husband Herman Gros. But I have proof that shows what they came with including vehicles and not the purported machines as she claimed. This affidavit has been attached as well. This claim needs and should be proved beyond doubt before the courts of law. The purchase of machines should as well be proven by her. I also have a letter written by Bernard and Michael Gros asking the immigration to allow them to come to Botswana and that they will take care of their parents although they were benefiting from their Pensions from South Africa and Britain.
4. In 2006 when all this was launched in court, Michael launched with the immigration purporting that I was making noise for him. He told the immigration to throw me out of Botswana. I was then picked up from home at 07:30hrs in the morning and only to find my brother in Law (Michael) was there shaking hands with an officer by the name of Kelebonye here in Maun. This made me to realize and scream that it was the works of Michael. Mr. Kelebonye called me in his office and told me he was withdrawing my resident permit. When I asked him about the court case, he said I will be travelling to and from Zambia. I later pleaded with the District Commissioner but this proved futile.
5. In 2011, Michael made a submission to the high court for him to sale the workshop in which he authorized the sheriff to sign on my behalf as he claimed that I was nowhere to be seen or found and yet I was in Botswana by then. I made this discovery when I went to Francis town High court to check on the progress because the case went quite for some time. If I did not check through the file, the workshop would have been sold by Michael Gros without my consent.
6. Michael is claiming a 50% from me and from the rentals of the workshop on which am also claiming the 50% from where ever he has been sub-contracting Desert Technical Service where am a shareholder from 2005 to date. He worked for companies like Yamaha and the Mines after the death of my husband using Desert Technical Services, where am also claiming my 50% of whatever he has been earning.
7. Am very much ready to pay him his P400, 000.00 being the 50% he is claiming from the workshop, but he is not realizing the papers for me to process the title deeds for me to access a loan from the bank.
Am further seeking for help from your company to accelerate this process before we go to court this month on the 19th. I also wish to put to the table the above points in the meeting we are to hold on the 15th April 2013.

Am pondering on seeking further assistance from the Zambian Embassy and Botswana Law suit.

Regards,

Nora Sitwala Lutangu Gros
