EMPLOYMENT CONTRACT AND PERIOD
We would like to take this opportunity to welcome you to MOTT MACDONALD and confirm your
employment with effect from 14th SEPTEMBER 2015. This letter sets out the terms and conditions of
your employment . Your employment with MOTT MACDONALD will endure for an initial period of TEN
(10) YEARS and it is subject to renewal after every 10 years period.
EFFECTIVE DATE
The effective date of this contract is the date of signature hereof, however should you have been
employed by MOTT MACDONALD prior to the effective date and continue to remain in the employ of
MOTT MACDONALD immediately preceding the effective date then the applicability of the time periods
for calculation of your holiday leave, will be calculated in accordance with the date you commenced
your employment with MOTT MACDONALD in terms of clause 1.1. above.
REMUNERATION
MOTT MACDONALD EMPLOYMENT CONFIRMATION LETTER
Your initial basic salary will be $11,550 (Eleven Thousand, Five Hundred and Fifty USD) per month,
payable with effect from 1st SEPTEMBER 2015, and is paid on the last day of each month (or on the
previous business day, should the last day fall on a Sunday or Public holiday). Salaries are reviewed on
31st October annually on the basis of such factors as merit, market practice, job grade and potential,
and are at the discretion of the management. In the event that your employment is terminated either by
you or by MOTT MACDONALD during your wage review month, you will not receive a salary increase for
that month.
EMPLOYMENT DUTIES
The following conditions of employment apply: You will report to Guy Leonard (Strategic Development
Director) who will determine your duties and responsibilities from time to time. Your employment is
subject to the conditions set out in the Human Resources Policies and Procedures manual, as amended
from time to time. You must conform to any other regulations, instructions and procedures that are in
force and which may be instituted at MOTT MACDONALD’s discretion. You may not accept work from
any agencies, nor render your services to any other company, firm or individual, unless permitted to do
so in writing by Guy Leonard (Strategic Development Director).You must be true and faithful to MOTT
MACDONALD in all dealings and transactions relating to the business and interest of MOTT
MACDONALD and to use your best endeavors to protect and promote the business, reputation and
goodwill of MOTT MACDONALD. You must devote the whole of your time and attention during working
hours and such additional time as the exigencies of MOTT MACDONALD business may require, to the
business affairs of MOTT MACDONALD and to your duties in terms of your employment with MOTT
MACDONALD.
In the event of the termination of your employment for any reason whatsoever, you are obliged to
return any MOTT MACDONALD assets or equipment in your possession, including any documents
belonging to the MOTT MACDONALD. Your employment is subject to the disciplinary and grievance
procedures in force, as amended from time to time. The Human Resources Policies and Procedures
manual will be given to you for your information.
You acknowledge that you shall be obliged to perform subsidiary tasks in addition to the primary tasks
for which you are employed. MOTT MACDONALD however undertakes that these subsidiary job tasks
will be within the training and experience or occupations capabilities of yourself and that you shall not
suffer any loss of remuneration or status for work performed on subsidiary tasks.
You undertake to: carry out all such functions and duties as are from time to time assigned to you and as
are reasonable or lawful; obey and comply with all lawful and reasonable instructions given to you by
your superior; submit to the management or to any person nominated by management such
information and reports as may be required of you in connection with the performance of your duties
and the business of MOTT MACDONALD.
You acknowledge that you shall be obliged on occasions to travel to customers’ premises in order to
properly perform your duties. Whenever such travelling is necessary, arrangements are to be coordinate
with the Director before any commitment is made to the customer concerned.
MOTT MACDONALD EMPLOYMENT CONFIRMATION LETTER
In the event that you utilized your own vehicle, MOTT MACDONALD will reimburse you for the distance
travelled for such purpose in excess of 75km per trip at MOTT MACDONALD’s ruling rates for such
reimbursement at the time applicable.
PERFORMANCE BONUSES:
Up to three (3) percent of your annual net salary will be paid annually as performance bonus.
TERMINATION OF EMPLOYMENT
Either you or MOTT MACDONALD will be entitled to terminate your employment on written notice
given to the other party, as follows: If you have been employed for four (4) weeks or less, either party is
required to give the other party one (1) week written notice. If you have been employed for more than
four (4) weeks, but not more than one (1) year, either party is required to give two (2) weeks written
notice.
If you have been employed for more than one (1) year, either party is required to give four (4) weeks
written notice.
Notice of termination of your employment may not be given:
During any period of leave to which you are entitled to; Must not run concurrently with any period of
leave to which you are entitled to; on any other day except the 1st day of the month, should the first
day of the month fall on a public holiday, or weekend then the first working day following such day.
MOTT MACDONALD will be entitled to terminate your employment without notice in compliance with
the relevant Labor legislation, as amended, and in terms of the Human Resources Policies and
Procedures Manual, which may include a disciplinary hearing, if you -
Commit any serious or persistent breach of any of the provisions of this agreement; Are guilty of any
other conduct which will justify summary dismissal at common law; Are declared permanently
incapacitated due to illness or injury which results in you being absent from work for an unreasonably
long period of time.
Notwithstanding the above, your employment with MOTT MACDONALD will terminate at the end of the
month in which you turn 70 years of age, unless you and MOTT MACDONALD agree otherwise in writing.
On termination of your employment you will be entitled to a certificate of service.
On termination of your employment you shall immediately deliver to MOTT MACDONALD all assets,
equipments, records, documents, accounts, letters, notes, memoranda and papers of every description
within your possession or control relating to the affairs and business of MOTT MACDONALD whether or
not they were originally supplied by MOTT MACDONALD and returned in good order, fair wear and tear
accepted.
CONFIDENTIALITY
MOTT MACDONALD EMPLOYMENT CONFIRMATION LETTER
You agree not to use for your own benefit or for the benefit of any other person and not to disclose to
any third party during operation of this agreement or after its termination, except in the ordinary and
proper course of MOTT MACDONALD business, any confidential information, including, but not limited
to, information regarding the trade secrets, customer lists, business affairs, suppliers’ lists, technical
methods and processes of MOTT MACDONALD.
ANNUAL LEAVE
You will be entitled to 45 Days consecutive annual leave on full remuneration in respect of each annual
leave cycle (which means the period of twelve (12) months immediately following commencement of
your employment). MOTT MACDONALD is obliged to grant you, annual leave not later than six (6)
months after the end of the annual leave cycle. MOTT MACDONALD may not permit you to take annual
leave during any of the period of leave to which you are entitled to in terms of the Basic Conditions of
Employment Act or during your notice period. All leave granted by MOTT MACDONALD must be taken at
a time convenient to MOTT MACDONALD and is subject to prior notice and approval of MOTT
MACDONALD. You are required to complete and submit the leave form as set out in the Human
Resources Policies and Procedures manual; Administration Form Annexure “C”, this form is to be
handed to MOTT MACDONALD for approval. All employees will receive 12.5% of their annual salary as
leave benefits payable upon the approval of leave form by the management. Any application to take
leave for a period in excess of three (3) working days must be submitted for approval at least four (4)
weeks prior to the intended starting date of such leave.
SICK LEAVE
You will be entitled to Two (2) weeks sick leave during every twelve (12) months of employment.
However during your first six (6) months of employment you are entitled to one (1) day paid sick leave
for every twenty-six (26) days worked. If you are absent from work for more than three (3) consecutive
days or more you are required to produce a medical certificate which must be signed by a medical
practitioner or any other person who is certified to diagnose and treat patients and who is registered
with the professional council established by an act of Parliament.
MOTT MACDONALD is not required to pay you your sick leave if you have been absent from work for
more than three (3) consecutive days, or on more than two (2) occasions during eight (8) weeks period,
and you do not produce a medical certificate stating that you were unable to work for the duration of
your absence on account of sickness or injury. You are required to notify MOTT MACDONALD by not
later than 0900hrs on the 1st day of your sickness or absence from your employment. You are required
to complete a sick leave form as set out in the Human Resources Policies and Procedures manual
immediately upon your return to MOTT MACDONALD. This form is to be handed to MOTT MACDONALD
together with the medical certificate.
Should you at any time become permanently unable, in the reasonable opinion of the MOTT
MACDONALD management, to perform your duties adequately by reason of ill health, MOTT
MACDONALD will be entitled to terminate your employment on such terms as MOTT MACDONALD, in
its sole discretion, considers reasonable. All employees will receive 7.5% of their annual salary as sick

leave benefits payable if employee did not embark on sick leave for a period of one annual cycle (12
months).
HOURS OF WORK
Your working hours shall be between the hours of (0900hrs to 1700hrs), Monday to Friday. You will be
entitled to a lunch break of one (1) hour which is to be taken between (1200hrs to 1500hrs).
You undertake and agree to work overtime whenever it is deemed necessary by MOTT MACDONALD.
You acknowledge that you will be employed by MOTT MACDONALD, inter alia, because you are
prepared to work overtime on occasions, and MOTT MACDONALD has employed you on this basis,
alternatively, you undertake and agree to work overtime when both the exigencies of MOTT
MACDONALD business require it, and it is reasonably convenient for you to do so.
Any overtime worked will be on a paid basis, unless by special prior written arrangement with MOTT
MACDONALD.
You will be required to work a minimum of forty (40) hours per week, but due to the varied nature of
your work, you may be expected to work additional hours which may be required to meet MOTT
MACDONALD objectives. This may include the occasional evening or weekends and may include country
trips, and may involve overnight stays away from home.
On occasions it will be necessary for you to attend training courses, conferences and meetings wherein
you will be required to stay away from home. Many of these events take place after working hours and
at weekends, and it is compulsory for you to attend.
MEDICAL AID
On commencement of service you will be obliged to join MOTT MACDONALD medical aid scheme, which
is currently MOTT MACDONALD employee care scheme. Details of this fund are contained in the Human
Resources Policies and Procedures manual.
It is compulsory for you to apply for membership of the medical aid scheme, unless you are currently a
member of another medical aid, in such event proof of your medical aid membership must be produced
within seven (7) days of the date of your commencement of employment with MOTT MACDONALD.
MOTT MACDONALD will pay 75% of your monthly contributions which is based on the MOTT
MACDONALD employee care scheme and you will be liable for the balance (1.5% of your monthly salary)
which will be deducted from your monthly salary.
If you belong to an alternative scheme then in such event MOTT MACDONALD shall contribute an
amount equal to the amount payable in terms of the MOTT MACDONALD employee care scheme
contributions, of the essential scheme.
PROVIDENT FUND
MOTT MACDONALD EMPLOYMENT CONFIRMATION LETTER
On commencement of service you will be obliged to join MOTT MACDONALD pension scheme and your
contribution (2% of your monthly salary) will be deducted from your salary. Details of the scheme and
contributions are set out in the Human Resources Policies and Procedures Manual.
GROUP LIFE INSURANCE
MOTT MACDONALD operates a group life insurance scheme for the benefit of employees and full costs
of the scheme shall be borne by MOTT MACDONALD.
COLLECTIVE ARRANGEMENTS AND AGREEMENTS
You will be bound by any collective arrangement or agreements concluded by MOTT MACDONALD and
employees employed by MOTT MACDONALD and/or the representatives of such employees.
FLEXIBILITY
In order to fully utilize manpower resources, all employees will perform work within their skills and
capability. To achieve this, individuals will accept any necessary training and be prepared to move from
job to job, as the needs of MOTT MACDONALD require.
You confirm that you recognize and support the complete flexibility of jobs and duties within MOTT
MACDONALD, both within sections/departments and between the various sections/departments of
MOTT MACDONALD, subject to individual skills and capabilities. In return MOTT MACDONALD
recognizes and accepts the need for training and retraining in the broadening of skills and in new
technological developments, as they affect MOTT MACDONALD’s efficiency as a engineering operation.
MOTT MACDONALD may, at its discretion and upon reasonable notice to you, transfer you from one
department or section to another, either permanently or temporarily.
TRAINING
You hereby consent to undergo such training as may be prescribed by MOTT MACDONALD from time to
time.
SECURITY
MOTT MACDONALD’s security regulations will be observed by you and may at the discretion of MOTT
MACDONALD be varied from time to time. You will not unlawfully possess any substance, article or thing
which is the property of MOTT MACDONALD or of any employee of MOTT MACDONALD.
GENERAL
No indulgence granted by a party will constitute a waiver of any of that party’s rights under this
agreement; accordingly, that party will not be precluded, as a consequence of having granted such
indulgence, from exercising any rights against the other which may have arisen in the part of which may
arise in the future.
MOTT MACDONALD EMPLOYMENT CONFIRMATION LETTER
No agreement, varying, adding to, deleting from or cancelling this agreement, will be effective unless
reduced to writing and signed by or on behalf of the parties.
This agreement as read with any collective arrangements or agreements and with the disciplinary,
grievance and retrenchment procedures laid down by the company from time to time, will constitute
the entire contract between the parties with regard to the matters dealt with in this agreement, and no
representations, terms, conditions or warranties not contained in this

3.0: WORK PERIODS:

Mondays to Fridays, Time: 9.00am to 5.00pm with break period between 12.00noon to 1.00pm. Expatriates are entitled to a one (1) month paid home leave.

3.1: SALARY INDICATION:

Monthly Salary of £ 4,500.00 (Four Thousand Five Hundred pounds) Salary can be transferred to any Bank or Country of your choice and all transfers must be made in conformity with the existing tax situation in UK.


3.2: ALLOWANCES:

Hazard/Inconveniences allowance, 5% of Basic salary.

Entertainment allowance, 5% of Basic salary

All allowances are paid weekly and locally in pounds (£) equivalent at the existing exchange rate.

4.0: PAID HOME LEAVE:

All expatriates are entitled to a one (1) month paid home leave, which can be taken once at a time or two (2) weeks apart one different period.

All expatriates shall be entitled to a leave allowance in (£) of an additional 100% percent of their basic salary. Free and free tickets to cover the span of their home leave.

5.0: SAFETY AND SECURITY:

Safety and Security of personnel Local/Foreign) and Facilities on Job Locations and Communities are not small issue, and have been seriously considered to ensure and assure hitch free operations.

All operations on Job Location are designed to adhere strictly to the Health Safety and Environment (HSE) Policy as applicable in the job location.


All expatriates are entitling to a free and mandatory safety courses on Job Locations to be delivered by qualified safety and environment experts.

All safety wears shall be provided by the Company at Job Locations e.g. Gloves, Shoes etc. at applicable in the job location.

6.0: MEDICAL/HEALTH SERVICE FACILITIES AND INSURANCE PLAN FOR FAMILY:

All expatriates shall be entitled to a comprehensive health care service, which are to be administered by Medical Experts on Job Locations.

In a case of emergency situation, an expatriate will be flown to his home country or any country suitable for the best medical attention.

This decision can be influenced by the findings of the Company's medical experts, unless the expatriate in question states otherwise.

After three (3) months of service all expatriates will be entitled to a Health Service Insurance Plan (HSIP) for family. The Health Service Insurance Plan is designed to cover only three (3) members of your family.

The Health Service Insurance Plan (HSIP) allowance can also be paid to the expatriates at the rate of £ 200.00 per family member per month which can be transferred on monthly basis without being subjected to tax.

7.0: FEEDING AND ACCOMMODATION:


Accommodation and feeding shall be provided for all expatriates by COMPANY.

All cuisine (Intercontinental/Continental) will also be provided.

7.1: TRANSPORTATION:

An official vehicle shall be provided on 24 hour daily basis to all expatriate for local transportation.

A round trip flight ticket to cover the span of your contract engagement will be provided and delivered to you on the completion of your relevant travel documents and Immigration particulars.

7.2: ADDITIONAL SERVICES:

Recreational/Sports Facilities shall also be made available at the disposal of all expatriates with no expenses to be incurred.

Laundry and Dry Cleaning Service will also be made available to all expatriates by the company laundry and dry cleaning unit.

8.0: TELECOMMUNICATION/INTERNET FACILITIES:


There are standard telecommunication facilities and internet services at the disposal of all expatriates, and same shall be accessible to all personnel (Local/Foreign) without any charge or expenses to be incurred.

Cellular Phones can be obtained by expatriates from the Local dealers/Service Providers in London, but must be used in accordance with the safety regulations on Job Locations.

9.0: FAMILY STATUS ARRANGEMENTS:

Family status arrangements can only be applied after at least three (3) months of service. The Application of family status arrangement indicates that an expatriate will be entitled to a free visa and air fare for his wife or Spouse or any other family member which is to be provided by the Company through the Travelling Agency/Consultant.

Expatriates who intend to travel with their wife/spouse within the first three (3) months of contract engagement will have the cost of visa and air fare being borne by them and can only be reimburse after three (3)months of service.

10: INTERVIEW:

There will be no interview since this is manpower job where anybody is fit to work excepting at the health and management sector where the company required at least first degree holders in job related.

VISA/WORKING PERMIT PROCESS:

TATA Consultancy Services Ltd have mandated a reliable agent to assure immediate visa processing for all appointed applicant coming from China, India, Pakistan and Thailand round the Asia to avoid delay causes by visa processing. On this note you are requested to follow any instruction giving to you by the agent or Embassy when applying for visa, you are responsible for any charges that can come across when applying for visa while company is responsible for your air-ticket and accommodation.
