I feel there is no harm in taking advice on any of the forums from anyone here, as no one blindly follow anyone. I m telling u that after reading so many different opinions, stories, no of docs to attach with application as much better prepared in the meeting with a solicitor and discuss everything and it helped me a lot, I feel that people should keep giving advice to each other as it helps a lot.

Sorry to hear about your news, pls take advice off your solicitor, be careful as a lot of rip you off and only make your case more complicated as they want to take money off you, trust me I know I urge you not to take too much advice off people on here no direspect but a lot of them will give you their point of view and compare their own case and confuse you even more.

Thanks guys for the support will keep you updated with what the solicitor says... I have thought about this all day and think I would go for the appeal but re-apply in may when I have completed the tax returns etc but I will be showing that I am earning 22,400. Also funny question but can I apply for wife and baby, even though the baby's not even born??

i understand that obv the child will be british.. but if the child id born abroad.. the father will have 2 be earning 22,000. jus to proove that he can support it. the reason i knw this is coz i know a few ppl hu r going thru it..

Having said all that, unfortunately it usually take more than six months to get the british passport of the baby from pakistan keeping in view DNA tests and other red tape etc.

Hi Mona,

If a child who is born to a british parent and have its own passport he/she will definitely be not applying for leave to remain in UK. The rule of children applies only to the one who are part of the application to get a visa.
Even if the father of the child is british the child will get the british passport no matter about the nationality of the mother, and if the mother of child is british the child will be british no matter the nationality of the father.
As per the rules in the UK the parents get child support and child benefits for british children so actually the british children are responsibility of the state.

Annex FM 1.7

2.3. The level of the financial requirement to be met in cases involving children varies and is
determined by the number of children who already have leave or are applying for leave at
the point of application.

2.8. The financial requirement will not apply to a child who:
• Is a British citizen (including an adopted child who acquires British citizenship);

In an appeal you can fight it. If you put you appeal in now.. You will have 11 months by then, and ten you can forward the 12th month to show it's a years worth... Also you can put an experdite letter to the judge first and they will see that mrs is pregnant.. Struggling ect. Ect. And maybe it can get turned around. It's a hard decision to make. I do know that since December the people that appealed had to wait a while due to back log...
If I could go back. I think I would do a fresh case... It's the time length if these appeal the courts are getting stupid... Inshallah you solicitor will guide you. But if you go through appeal defo do the experdite letter... Best of luck.

being pregnant doesn't matter but once the child is born the 22000 rule will apply. and ur right it doesnt count for British children.. onli if the mother is british.. bt if the father is british and the child is with its mother.. the father will have to show 22000 income.. sad but true..
