Momo: thank u that's sweet of you, the best anyone can do is dua and nothing is stronger than the dua of a believer

Saiqa: no they did not respond me and Khan were discussing the issue earlier when BHC responded on 5th Nov saying I did not submit my P60 etc when I did, we just wanted to help others whom are facing the same problem with BHC as the legal point can make a difference to everyone's case when we send a cover letter as part of the review process. The Data Protection Act can help applicants get their point across

Inshallah you will hear good news soon.

I can post the letter i sent to the BHC when i get home tonight but just a few points for the people in the same situation as me.

If BHC have lost your documents and are not taking liability consider the following:

I asked BHC and Gerry services take liability as I have evidence of documents I had sent, DHL receipts with full info of documents enclosed. Copies of all paperwork which my local Councillor had seen sight of and had mentioned in her letter to BHC.

DPA 1998: Breach of Data Protection Act as its the duty of BHC/UKBA to ensure all personal documents are kept and stored safe and secure.

under DPA 98 I should have been informed of the breach even if it was due to human error or security - point against BHC as the process was not followed according to ICO's guidelines for DPA so obviously nor risk measures were put in place to prevent this from happening again. no steps have been followed by BHC according to ICO's processes....I might just make a complaint to ICO now

BHC did not take liability and instead said i did not submit these documents. BHC has a track record of losing documents and don't forget breaching DPA is an offence and can be tried in a magistrates court or Crown Court.

They will reject my application now as I have challenged them but will forward me on to court where I am willing to challenge them again

i applied from karachi. this will be my first visit, my husband lives there. their recordings also announces that they will grant settlement visa within 15-20days. i dont know to whom they grant visa within this timeframe :(
