Did they trouble you for your surname issue?
You are fined only from the date of issue of your Portuguese Passport. CC issue date is not taken into consideration.

I had done just what you intend to do and later when i collected my Portuguese Pasport i was fined for illegal stay in India from the date of issue of the BI - this is my personal experience in Mumbai.
