Harassment for issue of Visa
I am a Child Specialist in Lucknow and this was my fifth trip to Europe...I had applied for Schenegan Visa on May 15, 2018 for journey date June 27th. Repeated emails to VFS and Italian Embassy, personal requests with VFS Delhi yielded no results. ONLY ANSWER...your visa is under process. Finally received a mail from embassy on June 20th stating that visas are being issued on basis of day of travel and I should have patience. Patience finally ran out on June 26th and I rushed to Delhi from Lucknow I personally made the same requests once again at the embassy ( not allowed in, but requested the peon to at least say a word to the visa officer)and literally laid siege at VFS office( like many others who were in same situation). Some amount of yelling, persistence and howling finally paid dividends and the visa was given on 26th evening at 8 PM by hand barely 24 hours before travel. The VFS was going to courier the passports to Lucknow on 27th June for the flight from Delhi the same night. Only Embassy and VFS can explain on How they expected a courier to reach Lucknow the same day to enable applicant receive it in Lucknow, board a flight to Delhi and then again fly to Rome the same day.
Points to consider:
1) Italy embassy has no business to hold on anyone's passport for 6 weeks. As per Regulation (EC) No 810/2009 of the European Parliament and of the Council of 13 July 2009 establishing a Community Code on Visas (Visa Code).....A decision on an admissible application must be taken within 15 calendar days from the date on which it was lodged. In exceptional cases, this time limit may be extended. The embassy is bound to take a decision within 15 days, if they need extra documents the applicant needs to be informed within this period and the processing time may extend for further 15 days. Hence there is GROSS VIOLATION of VISA CODE. People who submitted visas a few days before travel are issued visa while some like me are made to hang on for 6 weeks.
2) The embassy safeguards itself by mentioning on its website that confirmed bookings of airlines and hotels should not be done till visa is issued. In fact French embassy is known to refuse visas if booking is done through sites like booking.com etc. However when you go to submit your documents at VFS, they advise for a confirmed booking saying if you don't do this you are taking risk. Can Italian embassy give justification and guide whether any airline will hold the airline booking for 6 weeks, or any hotel will give free cancellation till day of travel or any sightseeing tour booked earlier would be fully refundable.
3) Frustrated to the limit....I opened a twitter account and sent messages to our foreign minister Mrs Sushma Swaraj and the PM's website highlighting this harassment. Unfortunately , since I was a common man, expectedly there was no reply.
4) It is business after all. Take as many applications as possible, earn visa fees, make the applicant make last minute bookings for airlines, hotels and tours thereby boosting their country's economy. Everyone is hand in glove. How come tour operators are getting bulk visas on time but individuals are being harassed till the last date. If the embassy cannot handle the rush, stop issuing visas but do not subject the applicant to last minute tensions, harassment, financial losses etc.
5) Where can i seek compensation ? NOWHERE...!! I missed attending two International conferences in middle of June because my passport was held up by the Italian embassy.
There is something which the Indian Government needs to look into else many travellers would continue to be harassed by these foreign embassies and VFS.
A piece of advise for fellow travellers.... don't apply on an individual level. Take hold of a travel agency as IT IS A BIG SET UP. Time is not far as this is a big bubble waiting to burst.!!
