Sir,
French enclaves in India were Pondicherry (capital), Karikal, Chandernagore, Mahe and yanaon. After Independance of India in 1947, the people (Bengalies) of Chandernagore situated in West Bemgal separated themselves in 1949 and merged with Indian Union, Thereafter on l.11.1954 France left amicably
left Fr.India by handing over the administration only
It is called defacto transfer having no legal effect,
Tnen, on 28.5.1956 the Governments of France and India entered into a treaty of dejure transfer of French India into Indian Union. This treasty came into force on 16.08.1962. It is from this date has run the period of six months given to french citizens born in Fr.India, aged 18 years (completed) and residing in Fr.India of Indian Union, to give in writing in the French consulate general of France at Pondicherry a declaration to conserve their french nationality. There is no change in nationality for those who have opted. The non optants lost their french nationality and became Indians from 16.8.1962. The renoncants had no special privilege under the above treaty in the matter of nationality, Yours sincerely.

sir,
my father is from pondicherry inn 1938
he was domiciled with his father and mother and total his family were out of india from 1955 to 1957 ie in myanmar
so he and his total family didnt give option since all were residing either at pondicherry nor in myanmar indian embassy.
married my mother from tamilnadu in 1972 registered in pondy
i was born in 1974 in pondicherry after treaty period.
my father died in 1984 died in pondicherry,
so pl confirm at the time of treaty taken place since he was in abroad with his all family members, whether he carries still his french nationality or lost french nationality.
if he is french whether i will also can claim cnf?

Your question is not clear, Any how I reply, The French consulate general in Pondicherry has jurisdiciton over Tamil Nadu, kerala and U.T. of Pondicherry and another UT. In the etat civil section of this Consulate general, the marriage between 2 french spouses are celebrated and registered, For mixed marriage ie, beween a french spouse and an Indian to be celebrated in the above States abd Union territory the french spouse and Indian spouse shall submit the relevant papers to the French consulate general in Pondicherry and get the fitness certificate for marriage after causing the publication of bans, Then the marriage can be celebrated amd registered om the concerned Mairie or in the office of Rgistrar of Marriage in UT of Poondicherry, In the above States the marriage is registered in the office of the Marriage reghistrar, The marriage certificate after apostille attestation shall be submitted to the Grench consulate general in Pondicherry for the process of tanscription in the french etat civil and delivery and marriage extracts and livret de famille. These can be obtained also in the Mairie in French language. Yours sincerely,

In French Indian population there were europeans, creoles (born to a French european and Indian) like Anglos-Indians, and indigent persons ie. Hindu,christians, muslims etc. They were french citizens subject to some exception. The europeans have two names ie. Nom ie(family name, surname) and first names (prenom) But the other categories of persons, have only a common name, without distinction of NOM and Prenom. If a perosn among Hindus, christians and muslims become renoncant, he will adopt a family name for him, his wife and his minor children and their posterity, Further a renoncant will lose his personal law (hindu laz, christian law, and muslim laz) He will be governed after his renunciation by the provisions of French code civil, like french perssns in France.In french India, after 16.8.1962, date of dejure cession of french India into Indian Union, a renoncant/optant will undergo no change in his nationality and applicability of French law, But the renoncant/non optant will lose his french nationality and become Indian. A curious thing he will continue to be governed by French lawz. because the act of renonciation is irreocable, You can see in every Indian Act Ilaw) the following caution entry, "This Act will not apply to Renoncants of ex French India" A renoncant/non optant can marry as before before the Mayor under French code civil. Under French law a wife is not an heiress of her husband, She is the joint owner with her busband for the immovable properties acquired by him during conjugal life, Similarly the husband is entitled to half of the immovable properties acquired by his wife after marriage, Finally I say, renonciation is different from nationality from 16.08.1072. my name is ravi sharma form bangalore.i want to ask one doubt.i saw your website details sir.its very useful to all to clearify your doubts.my father was renonounced but he did not optioned. my father did not optioned as i told,in that case we cant claim french nationality ,that is,both my father and me lost the french nationality.as my father and me born in pondichery at1915 and me born at 1953 in pondicherry.we have a renonciation document.according to the french law,if the loss of french nationality or the renoncant non opted persons can be reintegrated through the french code civil.as we have the renonciation which is the french code civil.it cannot be cancelled.It can be valid as i know sir. It is the important proof which i got clearly. okk sir.i am moving to the vital role.i asked my friends in the pondicherry,they intimated yours contact and let me to go and demande you.if i come to your office can you demande me??
