Sir, I applied for long stay student visa to France and my wife for long stay visitors visa there.Is it must to translate our marriage and birth certificates to french language?

Monsieur, A mon avis, les parents en France peuvent faire des demarches aupres de la prefecture du lieu de leur residence.
Dans l'Inde si le garcon est mineur, son tuteur ou la personne munie de l'autorite parentale des parents peut agir selon les instructions et procedures indiquees dans le site www.vfs-france.co.in. Bien sincerement.

sir.French indian territory was taken over de facto by the Govt. of India from 01.11.1954 and the treaty of cession was signed on 28.05.1956. It became applicable from 16th August 1962. From that date, French Indian territory has become Indian territory and acoordingly the inhabitants became Indians, But there are provisions in the treaty, namely in art. 5 as per which a possibility of option to remain French is given. Such an option was to be made within 6 months from the coming into force of the treaty of cession, A person having thus manifested his option to retain French nationality is deemed to have never acquired Indian nationality Similarly French nationals born in French Indian territory and domiciled in the territory of Indian Union on the date of coming into force of the treaty of cession have become nationals and citizens of Indian Union. They were also entitled to the right of option to remain French nationals. (Ref. French Legal system, by Justice David Annoussamy). Your father, having not opted, became Indian w.e.f 16.08.1962. yours sincerely,

respected sir,
my grandfather is ex-militry man in france. he registered his marriage and registered his sons first and before he died he registered for his daughter(example my mother). after few years my mother also got french nationality.she registered her marriage before few years and her children are above 18 years. is it possible for her children to get nationality? if so what are the formalities to be done by her children to get nationality...?

Is my father is a French National
Dear Sir,

First of all thank you for your reply on Thursday the 12th December, 2013.

Yes, my father has not opted his nationality during the six month period given to him. Because he really did not know about this option of six month period. Now only in my own interest I came to know about the Treaty of Cession and the six month option period by searching the internet.

In your previous reply you have told that “If he has not opted to conserve his French nationality (supposing his parents are French) he would have become Indian. on 16.8.1962.”

Now my comment is that according to Article 4 and Article-5 “French Nationals born in the territory of the Establishments and domiciled therein at the date of the entry into force of the Treaty of Cession shall become nationals and citizens of the Indian Union, with the exceptions enumerated under Article V. French Nationals born in the territory, by means of a written declaration drawn up within six months of the entry into force of the Treaty of Cession, choose to retain their nationality”.

Therefore, French Nationals who did not express their willingness to gain French Citizenship were automatically given Indian citizenship at the end of the 6-month period i.e. from 16.8.1962 to Jan. 1963.

Is my father was a French Citizen during his marriage ie. on 09-09-1962? (His marriage take place during the 6-month option period)

Sir, treat this case as a special one and please reply me in this regard. Than only I will proceed further in the matter of acquisition of nationality.

Sir, You have not explained your faher's situation with regard to the option required under franco indian treaty of cession, 1956. If he has not opted to conserve his french nationality (supposing his parents are french) he would have become Indian.on 16.8.1962. Your indian mother by her marriage on 9.9.1962 with an Indian (ex french) could not acquire french nationality. The questions about conservation or acquisition of french nationality should be asked to a frencn advocate by showing the relevant documents, and not in this forum, for getting a coorect reply, yours sincerely
