It is a State of Himalaya, between China and India. Born in Tamil Nadu in 1943 you can claim CBF if you are able to prove that your father and paternal grand father were french, Your father born in Singapore had no need to subscribe option. Yours sincerely,

Sir,
You state that your father renounced in 1949.So he renounced his personal statute (Hindu law) in order to be governed in future by french Code civil. That renunciation is irrevocable, He must have his local birth certificate, certificat de renonciation, marriage certificate, livret de famille. The renonciation applies also to his wife and children who are minors aged below 21 years on the date of renunciation, This document is sufficient to prove thast he was french,
If he was born in Pondicherry and staying there during the period of six months from 16.8.1962, he should have opted to conserve his french nationality,Otherwise he will lose his french nationality and become indian, For the renoncants the registers of etat civil were maintained in triplicate and the 3rd register of births, deaths and marriages were depsited every year in the Service central of etat civil in Nantes France). The renouncants optants are french nationals. But the renoncants non optants are Indians from 16.9.1962 but they are governed by french laws and not by indian laws.

my grand father worked in the french military during 1950-1960.he renounced in 1949.after the renounciation only he went to france to serve as the militaire.before went to france he is in the pondichery .i have doubt that if he served to military, first of all he should renonuced??and then if he done the paper work for going to france as a military man,whether he submits his fathers birth certificate? i want to clear these two doubts.please clear it sir.

Pondicherry was a french settlement in India. It was under french rule. On l.ll.1054 there was a defacto transfer to Indian Union. On l6.8.1962 by de jure transfer, French India inclusive of Pondichery (capital city) was merged with Indian Union, Legally speaking, Pondicherry was under the french regime upto 16.08.1962. Upto this date, French courts were functioning. Fremch citizems used to apply for CNF amd get the same from french courts. A person seeking govenment job should enclose with his application the nationality certificate and non conviction certificate (casier judiciaire) At that time the police officers were under the control of Prosecuting Judge called Procureur de la Republique
and Invstigating Judge (Juge d'instruction).The Procureur de la Republique is in the rank of a Judicial officer he will conduct criminal cases nefore Court lika a public prosecutor, and will not decide the cases. At his request, serious offences like sessions cases are investigated by the Juge d'instruction and not by police, If this Judge passes a committal order, it should be confirmed by the Indictment Bench (Chambre de mise de accusation) Then only the accused will face trial before Cour d'assise or cour criminelle, It is also called People Court, It is composed of 3 Judges (l presiding Judge and 2 assitant Judges and of 9 Jurors who are chosen by drawing into lot before the beginning of sessions trial, After trial the 3 Judges and 9 jurors will decide whether the accused are guilty or not, by secret ballot, If the majority of votes is in favour of the accused , they will be acqitted, The judgment by Cour d'assise is final and not appealable to Supreme Court (Cour de casation), except the cases om which question of law is involved). Regsrding civil cases, litigant public need not come to court, No trial,No examination of parties in open court, There is exchange of written statements (conclusions), notes, additional notes, etc At the final stage the advocates for the parties will submit their documents to the Court. After arguments the court delivers judgments with possibility for appeal in a majority ofcases, The number of cases will not be high. Under the french regime, there were two important officials called notasry public and conservaeur des hypotheques. The first officer performed the duties of advison, execution of documents. He will keep the original docts with him and issue copy with execution formula (grosse) and expedition (authentic copy). A notarial deed is a public document and is reliable in law, till a plea of forgery is raised) This speciality will reduce the filing of civil cases before courts. The second official (conservateur des hypoteques) will issue certificates of encumbrances
(cetificat negatif d'inscription et de non transcription).
