Complain
Dear Sir/Madam
I am Mr. James Obadeyan a citizen of Nigerian leaving Green at Court around Trade Fair area Accra, please I am calling for the assistance of Public Complaints & Court Inspectorate
Judicial Service of Ghana, Accra Ghana to help me look into my case, on the 6th of September 2017 last year I, my wife and 4 kids made an arrangement to rent (3) bedrooms from one Mr. Nii Lamtey through the means of an agent
So i was taken to the house by the agent and I saw the place, so we both went to the Landlord who is leaving adjacent to the compound/house and the land lord said the house will be vacant by the end of the month which is September 2017 last year, that I can pay him the money so I told him that I will only do the payment at the bank, so we both agree on that and he gave me his account information to go and make the payment after that I should come for receipt and agreement letter
After doing the payment, some days later I went to him for the agreement and receipt he only gives me the agreement that he has received amount of Ghs14,400 Ghana Cedis from me (Mr. James Obadeyan) being the payment of (2) years rent, a month is 600 Ghana Cedis for two years I paid for and I also paid to the Agent Ghs700 Ghana Cedis as a fees to Mr. Joseph the agent
After that, two months he said they have families meeting giving me stories so on and so on, so I contacted my lawyer to inform him of the whole deal in December that last year 2017 and my lawyer said I should come to his place so I went to meet him and explain to him, he said that we have to summon him (Landlord) to the court so I gave him the bank payment receipt and the agreement letter
On January my lawyer wrote application for writ of summons for him to appear before court on the 31th of January 2018,
On the 31th the (Defendant) wrote a letter to the court that he was sick so he cannot come to court until two weeks’ time case was adjoined.
On the second hearing he appear and the Judge ask him are you liable he said no and case was adjoin again for another two weeks
On the 28 of February he did not appear in court the Judge fine him for court hearing notice which I paid (Ghs40) and transportation (Ghs10) for the court to serve him, case was adjoin 2 weeks, on the next court date he came with a lawyer that they want the matter out of court that they want it settle of court, his lawyer and my lawyer exchange numbers and to meet in my lawyer’s office and the two lawyers left, that when the judge call our case I should tell the judge we have taken another date to appear in court in two weeks’ time but the judge rather give us a date which I also inform my lawyer of it
on the date we were given to appear in court the defendant GERSHON LAMPTEY fail to call for the settlement and I told the judge he wants to settle the matter out of court but fail to call for the settlement and the judge ask us to meet Alternative Dispute Resolution ("ADR") refers to any means of settling disputes outside of the courtroom. ADR typically includes early neutral evaluation, negotiation, conciliation, mediation,
We both went for ADR meeting, our statements was taken by the ADR so we were given a date to come for second ADR meeting but he fails to come so I and the ADR (Chief Togbe) went to meet him in his house and the meeting was discuses there, we both pay the transportation of the ADR for coming to his house and the meeting was discuses there in his house, the meeting was adjoin to meet in court for but still he fails to come to court and the judge ask me do I know why he fails to come to court today I said no my lord I don’t know why he did not come and the judge wrote on the case file, so I told the judge that I have been given a quit notice to vacate the place I am leaving with my families, (Wife and 4 kids) the judge said there is nothing he can do unless the ADR finished with his investigation
In our last meeting with the ADR, the ADR (Chief Togbe) ask Mr. Gershon Nill Lamptey (Defendant) since the house is not available for me to stay in because the ternate was still in the house they should refunds the money back with an interest, which was calculated with civil servant rate per annum for (7 Moths) and we both calculated Ghs17,284 cedis excluding my lawyer fees which was 1,500 Ghana Cedis, he was ask to pay 800 out of the 1,500 Ghana Cedis, of my lawyer’s fees and I told my lawyer about it he said to me that they were supposed to know that, but my expenses was not taken by the ADR that my lawyer did not file for it, and that will not be paid for or any compensation
The ADR drafted and agreement for both of us to sign I told him I have to inform my lawyer before I will sign it, he said even if my lawyer is here he cannot speak before him so he is doig the righting for me and that is how it is done, when I inform my lawyer on the phone he said I should sign, the ADR said that the Ghs17,284 Ghana Cedis should be paid twice and that the lawyer fees which was split should be paid at the end of April 30th without fail.
The court judge give us copies of the agreement to keep for our record, but when I called the defendant to remind him he said I should come to his house for the payment I said no he should please bring the money to the court but fail to bring the it to court up till now, so i called the ADR he said he is at the village now that I came meet another ADR if the money is ready, so I went to the court to inform the ADR department one (Mr. Titi) what is going on he said I should wait till week end Friday I will have pay some money to the court so they will send him court order, (Formal Decree)
Please the way the case is going on here, I am not seeing any improvement to my favor as it is going on with me now.
Please I am calling for assistance for the Nigerian High Commission and the Ecowas to look into my case for my help and assistance.
I have copies of the application for the writ of summons with suit file N0: AEDC/A2/158/18 and copy the agreement from the court with me.
The case is in DISTRICT MAGISTRATE COURT ACCRA-GHANA (COURT 3)
My lawyer Name is. SAMUEL R. OFORI ESQ
License LIC N0: GAR 17448/17
THE TRUTH CHAMBER
Note; up till now the defendant did honor the agreement from the court
Sure, my humble request will be considered

What is Nigeria government doing concerning Ghana Noncitizen Identification card. Which is been processed at the cost of $120.00. And $60.00 for yearly renewal. This policy does affects ECOWAS citizens in as much it affected non ECOWAS. This does not reflects diplomatic positive relationships as it's been made us to believe amongst the ECOWAS countries. Why is Nigeria not do the same. Paying such an exorbitant amount for a mere identification card that server no other purpose than a means of extortion and taken undue advantage of other west Africa Nationals residing in Ghana is something which is not acceptable. What is good for goose is also good for the gander. This is very wrong, it is unfair to us Nigerians and other ECOWAS community in Ghana. Nigeria government and ECOWAS must review whatever diplomatic agreements and call Ghana government to order.
