Requirement of Indian embassy for Legal Capacity certificate.
Note: All the required docs. should be produced to embassy to get the Legal Capacity & most critical among the all is "Certificate of Bachelorhood". Once you have the legal Capacity its easy to get married.

List of requirements for certificate of Legal Capacity before marrige.



1.) Original Indian Passport with photocopy.

2.) Original Valid ID of the Indian National & the Filipino national with photocopies

3.) Original birth certificate of the Filipino national issued by NSO national statistics office.

4.) Original Joint/ Separate affidavit of parents of the Filipino national giving consent to the marriage with the Indian national which is to be authenticated by Deparment of Foreign Affairs(DFA)

5.) Original Joint/ Separate affidavit of parents of the Indian national giving consent to the marriage with the Indian national which is to be authenticated by:




a.) Locally Notarized from India( If staying in India.

b.) Attested by Indian diplomatic Mission in the country( if staying outside INDIA)

6.) Copies of valid ID's of parents both Indian and Filipino.

7.) Original affidavit of singleness and willingness of the Filipino National authenticated by the DFA

8.) Certificate of no marriage (CENOMAR) from NSO for Indian and Filipino

9.) Joint affidavit from Indian and Filipino how they meet each other and what are their plans after getting married.

10.) original employment certificate from the company of the Indian national

11.) Certificate of Bachelorhood from the Indian National or next of kin or parents or authorized person issued by

a.) area Sub-Divisional Magistrate (SDM) or executive Magistrate or district Magistrate (DM) or court authorities or any other officer authorized by government indicating the marital status of the person ( area is to be determined on the basis of address in the Indian National Passport.

b.) above certificate/affidavit is to be counter attested by the home department of the state concern and after that

c.) the same is also to be counter attested by the CPV Division of Ministry of External Affairs (MEA) at Patiala House, Tilak Marg, new Delhi or by the branch Secretariates of MEA at Chennai, Guawahati, Hyderabad, Kolkata.

12.) In case the Indian National is already married (in Philippines), divorsed or the spouse has died:

a.) a certificate/affidavit from the Indian National or his parents or authorized person indicating:

----that the Indian National is not married to anyone in India

----that the Filipino National is the only spouse since-----(date),

----has ----children and their names if any

OR --the marital status after divorce and death of spouse


a.) area Sub-Divisional Magistrate (SDM) or executive Magistrate or district Magistrate (DM) or court authorities or any other officer authorized by government indicating the marital status of the person ( are is to be determined on the basis of address in the Indian National Passport.

b.) above certificate/affidavit is to be counter attested by the home department of the state concern and after that

14.)Application is upon approval of the consul.

15.) processing time 3 working days.

Certificate to get married with a Philippine national
What I understand from Embassy of India, Manila, among others, for a Philippine national a certificate of no marriage from NSO (National Statistics Office, Philippines) is a must for the Indian as well as the Philippine national.
In addition to this, for an Indian national, it is essential that he/she should get a certificate/affidavit of bachelorhood/singleness from the area judicial authorities in India (area as per address in Indian national's passport) stating that he/she is not married to anyone in India.
The above certificate/affidavit has also to be signed by the appropriate authorities in the home department of the state concerned and also by the CPV (Consular, Passport, Visa) Division of the Ministry of External Affairs.
Only after the document would be accepted by the Embassy of India, Manila

Dear Sir/Madam,

Could you advise how to obtain a legal capacity of marriage which is required by the philippines embassy to marry a filipina, I am in Dubai and would come to Philippines next month to visit and the same time to get married. Is it possible to apply online and will take the result upon arrival in your office in manila? please advise. Its really important and urgent.

Hi, i have an indian bf and were planning to get married nextyear in Philippines. I inquire at Philippine Embassy thru online and they said i had to sponsor my bf but then what else does he has to prepare any requirements from your indian embassy? Pls help us.
