German living in Quito

Poor telephone service
I have lived in Quito for more than 2 years now and dealt with the German embassy on several occasions. When visiting the embassy the staff is always very friendly and helpful.
However, the telephone service is almost always very poor. The Ecuadorian gentleman than usually answers the phone (extension 0) speaks poor German and constantly seems to be in a bad mood. The only information he ever gives (in a very unfriendly manner) is at what time you have to call back in order to speak with the person in charge of the respective matter.

I find this very disappointing and believe that the German embassy deserves a better representative.

- hereinafter referred to as "Employer" -


and Mr Nestor Alfredo Carrasco Gallardo
SANTA ELENA
CANTON LA LIBERTAD
ECUADOR
- hereinafter referred to as "Employee" -


the following Employment Contract is now hereby entered into:



1. Commencement of the employment relationship
The employment relationship shall commence on the date of signature.


2. Activity
The Employee shall be employed as a
Boxing Coach

and shall be employed to carry out, more particularly, the following activities:

- Preparing the Employer for a Boxing World Championship Title Fight to be held in 2012;

- Training other boxers (children, adolescents and adults) as determined by Employer.

He undertakes to carry out other reasonably acceptable work – at a different location, too – which corresponds to his existing knowledge and skills and does not involve a reduction in wage or salary.


3. Compensation
3.1. The Employee shall be paid monthly gross compensation of € 1.200,-.

3.2. The Employee shall also be entitled to a share of ten per cent of the fees won by Employer himself or by boxers who have been trained by Employee upon Employer's request.


4. Exclusivity
4.1. During the term of this Contract the Employee may only train boxers which have been determined by Employer.

4.2. For a period of five years after the termination of this Contract the Employee may not train any boxers whom he has trained during the term of this contract unless Employer expressly permits it.


5. Illness
If the Employee is unable to work because of illness not caused by him, he shall be entitled to continued payment of the compensation for the duration of six weeks in accordance with the statutory provisions. The prevention from work must be notified immediately to the Employer. Moreover, a medical certificate concerning the inability to work and its probable duration must be submitted prior to the expiration of the third calendar day after the commencement of the illness.


6. Duty of Secrecy
The Employee undertakes to treat all business and trade secrets as confidential for the duration of his employment relationship and after he leaves the company, too.


7. Ancillary activity
Any ancillary activity in return for payment or that impedes the employment relationship shall not be admissible without the consent of the Employer.


8. Contractual penalty
If the Employee does not commence the employment relationship as contractually agreed upon or ends the employment relationship contrary to the contractual agreement, the Employee undertakes to pay to the Employer a contractual penalty in the amount of one gross monthly compensation.

For each boxer trained by Employee in violation of the above paragraph 4.2 (Exclusivity) the Employee agrees to pay a sum of one hundred thousand EUROS to Employer.

The right of the Employer to assert more extensive damage claims shall not be affected.


9. Termination
9.1. The period of notice shall be four weeks to the 15th or end of a calendar month. Any statutory extension of the period of notice for the benefit of the Employee shall apply in the same way for the benefit of the Employer. The notice of termination shall require the written form. Termination shall be excluded before the commencement of the employment relationship.

9.2. The Employer shall be entitled to release the Employee from work until the end of the employment relationship. The release shall be subject to the offsetting of any claim to vacation to which the Employee may still be entitled or any credit on the working time account. During the period of release the Employee shall accept the offsetting of any compensation earned by using his working capacity against the claim to compensation vis a vis the Employer.


10. Expiry/preclusive periods
The contracting parties must assert any claims under the employment relationship within three months following their due date in writing and institute legal proceedings in the event of rejection by the other party within three months.

Otherwise the claims shall become extinct. Any claims under tort shall still be governed by the statutory provisions.


11. Amendments and Ancillary Agreements
Any amendments and ancillary agreements shall not be valid unless in writing; this shall also apply to the revoking of the written form itself.

Should individual provisions of this Contract be or become invalid, the validity of the Contract as such shall not be affected.

The Employee undertakes to inform the Employer without delay of any changes in his personal situation such as marital status, number of children, address.
